INTRODUCTION


The Shadowlawn Homeowners' Association is comprised of the property owners of the Shadowlawn Townhome community. The Association was organized in 1984 as the managing authority for the common grounds and to provide services to the members which would enable Shadowlawn to become and remain one of Tallahassee's premier townhome communities. Restrictive Covenants are on file at the Leon County Courthouse which detail the specific authority and responsibilities of the Association and the member owners. A copy of these Covenants, as well as copies of the Association's Bylaws and Articles of Incorporation are available to members on the KRM Management, Inc. Website. (Go to KRMTAL.com, then select Shadowlawn from the drop-down list under Community Associations.) Each owner should make themself aware of the requirements of the Association's Covenants and is responsible for both informing their tenants of and enforcing these requirements, as well as the Association rules contained in this handbook.


The Association elects a volunteer board of directors each October at the Annual Homeowners' Meeting. Directors serve one-year terms and meet each month to review, discuss, and act on the current business of the Association. Nominations are solicited from Association members and should be submitted by September 1 of each year. Nominations received after September 20 cannot be accepted due to Annual Meeting notification requirements. Directors do not receive compensation for their services to the Association.


The Association provides a copy of its current financial statement to members to inform them of where their assessment dollars go. All monies collected through the annual assessment go directly to maintenance, and to provide the other services as described on following pages. HOMEOWNER ASSESSMENTS


The homeowner assessments are fees each property owner of the Shadowlawn Homeowners' Association pays to fund the responsibilities of the Association. These fees go directly to maintaining the lawns, swimming pool, parking lots, and other expenses incurred by the Association as a direct result of providing services to its members. Fees are assessed on each townhome or lot owed within the Association.


An assessment notification is sent each December stating the fees due for the next year on each townhome or lot.


Assessments are due on January 1st of each year and delinquent at the end of January. Assessments not paid in full by January 31st are subject to interest charged on the unpaid balance. Interest is calculated at a rate of 12 percent per annum on the unpaid balance. Those accounts more than 60 days delinquent are referred to the Association's attorney for collection and become liable for all attorney, collection, and court costs as applicable.


If you have any questions concerning the assessment, please address them in writing and mail them to the Association's address.

 


ARCHITECTURAL CONTROL & EXTERIOR MAINTENANCE


All proposed changes, additions, alterations, and improvements to any exterior area of a townhome or grounds must be approved by the Association's Architectural Committee. All proposals must be received by the committee and the receipt acknowledged at least thirty (30) days prior to the commencement of the proposed construction. Complete architectural approval guidelines are contained within the Associations Restrictive Covenants and its amendments, and should be referred to for specific information. Only those requests submitted by the actual property owner will be considered.


No building, fence, wall, or other structure shall be commenced, erected or maintained, nor shall any exterior addition to or change or alternation shall be made until the plans and specifications showing the nature, kind, shape, height, materials, and location of the same shall have been submitted to and approved in writing as to the harmony of external structures and topography by the Architectural Committee or the Board of Directors.


All requests for Architectural approval should be mailed to the Association’s address.

 

Each owner is responsible for the exterior maintenance of their townhome including but not limited to trimming and maintenance of trees and shrubs and cleaning gutters on an individual’s property. This includes repairing, staining, painting, and generally maintaining the appearance and condition of the townhome comparable to the condition at the time of its initial construction, excepting only normal wear and tear.


The Association reserves the right to notify owners of the need to repair, maintain, and/or replace any of the above and other items as becomes necessary to maintain the safety, integrity and appearance of individual townhomes and of the community as a whole.

SERVICES PROVIDED BY THE ASSOCIATION


Through the collection of the homeowner's assessment, the Association is able to provide the following services:


Lawn maintenance of common grounds which includes: regular mowing, removal of debris, pavement edging, hedge trimming in common areas,, landscaping, and other services as needed. Maintenance of fenced-in back yards and patios of individual townhomes become the responsibility of the individual owner and/or resident.


Swimming pool maintenance which includes: routine maintenance and repair of the pool equipment, chemical treatment of the pool water, and maintenance of the pool facilities in a safe and sanitary manner.


Parking lot maintenance and assigned, reserved resident parking. Parking spaces are designated with stripes and unit numbers painted on the pavement.


Security lighting in each of the parking lots and around the pool facilities.


OWNERS MUST


Owners are responsible for the maintenance of the exteriors, cleaning gutters and maintaining the shrubs of their units as well as all shrubs immediately adjacent to their units.



GENERAL INFORMATION


This information is provided to inform owners and residents about the Shadowlawn Townhome community's general rules and regulations. Specific areas are covered in further detail on the following pages.


Common Property


The Association owns and maintains the common property within the Shadowlawn Townhome Community. These common areas makeup the lawns, parking lots, and swimming pool and are provided for the enjoyment of all residents. No one has exclusive use of these common grounds and owners and residents should use these facilities with consideration and courtesy.

 

Speed Limits


The posted speed limit on Hartsfield Way is 25 mph. The speed limit in the parking areas and driveways is 5 mph.


Personal Property


Personal property is to be stored in the rear patio closet or in a neat manner on the back patio of your townhome. Garden hoses, buckets, lawn chairs, barbecue grills, coolers, and other items are not to be kept in front of your townhome. Items left in front of residences, on lawn areas, in parking lots, and other common areas are subject to removal without notice.


PARTIES

 

Because of the limited living space, all residents are asked to exercise common courtesy when hosting parties or other large gatherings. A. general rule to follow is to invite only the number of guests that can be comfortably accommodated inside your residence. Parking lots and other common areas are not available to residents as sites for large gatherings. Resident hosts are expected to cleanup all party debris within 24 hours of any party they have hosted.


LOUD NOISES/MUSIC


Please be considerate of your neighbors when entertaining or playing music. Nothing is guaranteed to cause problems between neighbors more than someone making loud noises or playing loud music (either in the car or in the residence) when others are attempting to sleep, study, or enjoy a quiet evening.


GARBAGE CONTAINERS AND RECYCLE BINS


Garbage containers and recycle bins are to be kept on the side or in back of residences. Recycle bins are to be brought to the curb on recycle day and returned to proper storage areas during the week. Garbage containers and recycle bins are not to be left in parking lots, on the curb, on the lawn, or other areas between collection' days. Neither the garbage containers nor the recycling centers are to be left in front of the units except on the day of collection.

Recyclable items include: newspapers, soft-drink bottles and cans, tin cans, plastic milk containers, and glass containers. Plastic grocery bags are not collected by the City of Tallahassee, but are collected by area grocery stores for recycling.


PARKING AND TOWING


Each townhome residence is allocated two (2) parking spaces. These spaces are indicated by the residence number painted on the pavement.


Limited visitor parking is available on a first come basis only. These spaces are reserved for guest parking only, residents may not utilize guest spaces for their own personal use.


Parking is permitted in designated spaces only. Vehicles parked in non-designated parking areas/spaces will be towed at owner's expense.

Vehicles blocking parking lot entrances or access lanes will be towed at owners expense.


Parking on the lawn is not permitted at any time. Vehicles parked on the lawn will be towed at owner's expense.

Recreational vehicles may be parked in the resident's assigned parking space , ... providing this does not obstruct other vehicles from entering or exiting parking spaces, driveways, or otherwise create hazardous or noxious conditions. Recreational vehicles may not be parked or stored in guest spaces, on lawn areas, in parking lot access lanes, or other areas of common ground.


Residents may utilize the City of Tallahassee's right of way on either side of Hartsfield Way for extra parking needs: Vehicles should not be parked within ten (10) feet of parking lot entrances Make sure that the entire vehicle is off the pavement so as not to obstruct traffic on Hartsfield Way. Vehicles parked on the right-of-way are subject to City of Tallahassee ordinances and police enforcement


Junk, unlicensed, unregistered and non-operational vehicles may not be parked in the parking lots. Residents may not "store" vehicles in the parking lots. These vehicles will be towed at owner's expense. (Non operational vehicles are defined as any vehicle not able to be driven on public roads either because of mechanical or legal reasons including but not limited to lack of a current registration tag.)


Vehicles in violation of the Shadowlawn Homeowners' Association's parking policies will be towed at owner's expense without prior notification to the owner.


Neither the Association nor its representatives are responsible for monetary expenses incurred to the owner, items lost from, or physical damages to the vehicle as a result of being towed.

PETS


The Shadowlawn Homeowners Association requires that all pet owners restrain their animals from becoming nuisances to other residents.


Property owners are requested to limit the number and size of animals their tenants may maintain in residences. Owners should be aware that they may be liable for damages in cases involving animals maintained on property they own and may want to check with their property insurance carriers.


Nuisance animals will be reported to the appropriate authorities. The City of Tallahassee and Leon County require up-to-date rabies vaccinations for dogs, cats, and other pets.


The following conditions are required by the Association:


Lawns and other facilities which house or maintain pet animals are to be kept clean and in a manner as to prevent odors and other unsanitary conditions.


Pets are to be on leashes when not in a fenced enclosure or inside the owner's residence.


Pets are to be walked along Hartsfield Way, in the vacant lot across from the pool, or owners may utilize the field located at the end of the cul-de-sac. Pets are not to be allowed to roam at will within the community


Residents may not maintain dog pens or runs on lawn areas.


Pets are not permitted within the fenced pool area at any time.




Pets are not permitted in the swimming pool at any time


Owners are asked to restrain their dogs from excessive barking.


Owners should remove their pet's fecal matter from lawn areas near residences, mailboxes, and pool.


Property owners should encourage responsible pet ownership from their tenants by informing them of the association’s Pet Owner Rules and enforcing these requirements when necessary. Owners will be informed of situations involving their tenants’ pets if problems or complaints occur.

POOL RULES


The Association maintains the swimming pool for the enjoyment of owners and residents of the Shadowlawn. Listed below are the Association's pool rules. Failure to follow these rules may result in loss of pool privileges. Key access is required. Persons observed climbing the fence or prying open the gate lock will be considered trespassing. The pool is private property. Trespassers will be prosecuted.


NO DIVING! SEVERE injury may result from diving into the pool.


No one under the age of thirteen (13) is allowed in the pool without proper adult supervision. Children observed in the pool without supervision will be asked to leave the pool facilities. Repeated unsupervised visits may result in loss of pool privileges for everyone in the unit.


Bathers should shower before entering the pool. A shower is located on the west side of the pool house.

Pets are not permitted within the fenced pool area at any time for any reason.


Do not play with the safety equipment. This equipment is provided for use in emergencies situations only. No horseplay or running in the pool area.


Guests must be accompanied by their resident host at all times.


No glass or other breakable items in the pool or on the pool deck. Food and drink items in unbreakable containers are allowed providing that all debris is removed and properly disposed of in trash receptacles.


Bathers should remove personal property when leaving the pool area, Items left at the pool may be disposed of without prior notice.
